TERMS AND CONDITIONS

In the Terms and Conditions the following definitions apply: ”Company” means Equi-Ride LLC. ”Client” means any person that has completed and submitted a disclaimer form, and which has been accepted by the Company. ”Facilities” means any one of the Equi-Ride LLC rooms and other facilities operated by at Equi-Ride LLC at Fredericks Equestrian International LLC located at 1150 NE 105th LANE ANTHONY FLORIDA 32617.

 ”Terms and Conditions” means these Terms and Conditions.

References in the Terms and Conditions to the singular will include the plural and vice versa and references to the masculine gender will include references to the feminine gender.

The Terms and Conditions are incorporated into the disclaimer form.

The Company reserves the right to vary and revoke the Terms and Conditions from time to time which variation it may consider necessary or desirable for the regulation of its affairs and the conduct of Clients. Any such changes will be notified to Clients and, until revoked, are and will be binding on Clients.

The Terms and Conditions will be governed by the Federal laws of the USA and State Laws of Florida and subject to the exclusive jurisdiction of the USA courts.

Equi-Ride LLC CLENTS

Subject to these Terms and Conditions, when a person has completed the Disclaimer Form he will become a Client of the Company.

Acceptance of a person as a Client is in the absolute discretion of the Company.

The Company reserves the right to expel from its Facilities, suspend for a specific period or refuse to renew the membership of any Client whose conduct is or may, in the Company’s reasonable opinion, be injurious to the character of the Company or which amounts to a breach of the Terms and Conditions or where such expulsion is otherwise in the interests of the other Clients of the Company. Any Client so expelled will forthwith cease to be a Client of the Company and will not be entitled to any refund for any period during which his membership is suspended.

Clients must be 16 or over to enrol in Equi-Ride LLC sessions.  Children aged 16 years and older may enrol only in Simulator Private Lessons and parent or guardian will be required to be present.

SESSION TIMES

Details of session times may vary from time to time. Session times will be published by the Company and will be available either at the Facilities or at Equi-Ride LLC

facility or published on their website.

PAYMENT TERMS

Details of session prices and gift certificate prices are available either at Equi-Ride LLC or directly from the Company and will be such prices as determined by the Company from time to time.

A Client may not attend any session without first booking and paying for the relevant session.

Payments for sessions and gift certificates in any amount are non-refundable unless otherwise stated in the Terms and Conditions.

 

BOOKINGS AND CANCELLATIONS

A Client may only book or reschedule sessions for themselves via contact with their Equi-Ride LLC trainer.

Cancellation Policy: Reservations for sessions can be cancelled online for no charge up to 24 hours prior to the beginning of the session. 24 hours’ notice is required for cancellation of single sessions.

Sessions are booked on a first-come first-served basis. If a Client is added to a session from a waiting list, he must confirm his reservation 2 hours prior to the start of the session. 

FITNESS AND HEALTH

By agreeing to these Terms and Conditions Clients hereby confirm that they have no health problems (including without limitation cardiac irregularities; spinal, bone, joint, tendon or ligament injuries; spells of dizziness; asthma (or other breathing difficulty); diabetes, epilepsy or any allergy) which may affect their participation in any sessions at Equi-Ride LLC

It is a Client’s sole responsibility to notify the Company before attending any session of any circumstances affecting his health which may be exacerbated through continued use of the Facilities and/or which may have arisen or worsened since his last session at the Facilities (if any).

Clients are advised not to undertake strenuous physical activity without first seeking medical advice if they have concerns over their physical condition and wellbeing. Clients with low/high blood pressure and/or cardiac irregularities should not attend class. If there is any doubt, the Client should consult his doctor.

The Company reserves the right to refuse access to any Client if, in its absolute discretion, it considers that the health of the individual concerned may be endangered by the use of the Facilities.

Clients are required to follow the instructions of the instructor at all times.

USE OF FACILITIES

A Client is entitled to use the Company’s facilities provided always that the Company may at any time without notice withdraw all or part of its facilities for any period or periods and with notice, where practicable, in connection with any cleaning, repair, alteration or maintenance work or for reasons beyond the control of the Company.

PERSONAL BELONGINGS

Personal belongings are brought onto the Company’s premises and those of Equi-Ride LLC at the Client’s own risk and the Company does not accept liability for any loss or damage whatsoever to such items.

DRESS

Clients are requested to wear a form of dress appropriate for riding activities. Clients riding the horse simulator should wear comfortable, stretchy trousers (breeches or jodhpurs ideally) and riding footwear. Please note that boots must not have zips on the inside. If Clients usually wear gloves when riding they may like to bring them. Riding hats are mandatory.

SAFETY & HYGIENE

In the interests of safety and hygiene, no crockery, glass or food are permitted in all areas of the Facilities unless it has been pre agreed in the case of a Group Lesson. Only closed containers of water are permitted in the Facilities. 

Fire exits, which are clearly marked, are there in the interests of safety and Clients must not interfere with these exits for any reason. In the event of a fire, Clients are asked to make their way to the nearest available exit.

Smoking is forbidden in the Facilities and in all areas of Equi-Ride LLC and the surrounding areas of Fredericks Equestrian International LLC.

GENERAL

Clients are required to give written notice to the Company of any change of address. Failing such notice, all communications will be assumed to have been received by the Client within five days of mailing to the last address notified to the Company.

The Company reserves the right to refuse admission to its Facilities.

The Company may, if a Client so wishes, communicate with the Client by electronic mail (“email”). By providing an email address to the Company the Client consents to receiving email communications from the Company, including notices pursuant to the Terms and Conditions. The Client also accepts the risk that email may not be a secure and confidential means of communication. The Company will not be liable for any loss or damage suffered as a result of communicating with a Client by email.

Clients must at all times observe the Company’s guidelines which may be notified to them from time to time and are requested to comply with any reasonable directions which the management of the Facilities may issue to ensure the smooth operation of the Facilities for the convenience of all Clients.

Any marketing, educational or other materials of any nature whatsoever produced by the Company in connection with the Facilities and which are made available to Clients at the Studio will at all times remain the property of the Company and will be subject to the Company’s copyright.

PURCHASE POLICY

Equi-Ride LLC PRIVATE SIMULATOR single class expires 1 month from purchase

Equi-Ride LLC PRIVATE LESSON 3 pack expires 3 months from date of first lesson

Equi-Ride LLCPRIVATE LESSON 5 class pack expires 5 months from date of first lesson

Equi-Ride LLC Introductory Simulator class expires 14 days from purchase. One per person.

Equi-Ride LLC 10 class packs have 3 month expiry from date of first lesson

Equi-Ride LLC 20 class packs have 6 month expiry from date of first lesson

LIMITATION OF LIABILITY

The information available on or through this website, and the Services supplied via or in connection with this Site or at the Equi-Ride LLC Facilities do not constitute medical advice and it is  the Client’s responsibility to determine, through obtaining appropriate medical advice, that he is fit and well and that such contents and services are suitable for him. It is not the Company’s responsibility to do so. Before commencing any exercise regime, the Client should consult his doctor. It is also vital that the Client supplies the Company with correct information about himself. The Company cannot be liable for any incorrect information supplied by the Client. The Company attempts  to ensure that all information contained on this website (and provided by the Company to the Client as part of any Services or Products) is correct, but, subject to the paragraph below, the Company does not accept any liability for any error or omission and excludes all liability for any action a Client (his legal representatives, heirs) may take or loss or injury a Client may suffer (direct or indirect including loss of pay, profit, opportunity or time, pain and suffering, any indirect, consequential or special loss, however arising) as a result of relying on any information on this web site or provided through any Service supplied by the Company to you. Clients and their legal representatives and their heirs release waive, discharge and covenant, not to sue Equicise Limited and its instructors for any injury or death caused by their negligence or other acts. Any Client questions or complaints should be addressed in writing to the Company at email equiride.usa@gmail.com.

The Company cannot be held responsible for any particular session, instructor and/or item of equipment not being available for whatever reason. The Company reserves the right to make alterations to the sessions, instructors and/or equipment, as well as to those ancillary facilities provided to Clients, without notice and in its absolute discretion and the Company will not be liable for any loss occasioned by such alterations except insofar as such loss is by law incapable of exclusion.

It is the Client’s responsibility to ensure that he is capable of undergoing a routine of exercises provided by any programme which he follows or class which he attends. Clients accept the risk of injury from performing exercises and using specialist equipment and are advised to consult their doctor prior to beginning any session. Advice provided by the Company’s instructors at no time constitutes medical advice in substitute for advice provided by a medical professional.

The Company accepts no liability for loss or damage to property of Clients or for injury to Clients on the  Company’s premises or those of Equi-Ride LLC except insofar as such loss, damage or injury is by law incapable of exclusion.

In consideration of his participation in the activities and programmes of the Company and the use of facilities and equipment owned and/or under the control of the Company the Client hereby waive and release the Company from any and all responsibility or liability for injuries or damages resulting from his participation in any of the Company’s activities or use of the Company’s equipment or facilities save in respect of death or personal injury caused by the negligent act or omission of the Company.
